Constitutional justice supports the continuation of affirmative action in a more honest form. Affirmative action measures should be open and explicit and the true intent to further particular races or groups should be admitted and embraced. Affirmative action is a minor positive step to remedy the past destruction of a culture and should not be terminated until equal opportunity is realized. Affirmative action has lost its usefulness partly because so much of what one sees and hears on the subject smacks of hypocrisy or speaking in code. Affirmative action, with all its costs and imperfections, is not inconsistent with the commitment made by this nation when it enacted the Fourteenth Amendment. On the contrary, there is a reason why Congress enacted "colored relief" legislation at the same time this commitment was laid down. The mason is justice--constitutional justice. (Kennedy, 1987)
