There is always more than one school of thought regarding any major issue being faced by a country. Death penalty is one such issue that has two common arguments one in its favor being deterrent and reward for committing the heinous offence and other one being harsh and conflicting to the American constitution. The big question remains to be answered is that whether capital punishment really proving a deterrent or it is violating the 8th amendment of American constitution that restricts all cruel and unusual punishments. It is generally believed that the death penalty proves to be deterrence against homicide. Those who support believe retribution argue that it is the religious obligation to act on the old testament that lays down the law that fits the crime “ An eye for an Eye” .based on this principal the punishment for death is nothing else but death. They also claim that it is less expensive than life punishment whereas opponents contest loss of a life for any crime. Some 47 states in America are adhering to life sentences with out any possibility of parole.
Some six states in America had abolished death penalty in mid Nineteenth century but the same was reinstated by 1920.during 1950,s death penalty was again disliked and the executions fell considerably in America. The executions in 1940,s were 1289 that were reduced to only 715 in 1950,s and during 1960 to 1976 these were only 191. Before 1960,s 8th amendment was considered as supporting the death penalty but later elementary legitimacy of the death penalty was challenged and it was argued that the death punishment violated the 8th amendment. In 1972 the death penalty was declared some what conflicting to 8th amendment by Supreme Court..................
