For almost forty years, the Civil Rights Act of 1964 has esteemed the right of spiritual groups to make conscientiously based employment decisions. Title VII of this Act which is sustained by Republicans and Democrats alike defends Americans from employment discrimination found on race, color, religious conviction, gender, and national origin. It as well defends the capability of faith based organizations to sustain their religious freedom and individuality by hiring employees who share their spiritual beliefs.
Title VII clearly states that employers cannot discriminate of sex, color or race and it also provides that:
“It shall be an unlawful employment practice for an employer: (a) to fail or refuse to hire or discharge any individual, or otherwise discriminate against any individual with respect to his compensation, terms, conditions, or privileges of employment because of such individual's race, color, religion, sex, or national origin.” (Fitzgerald, L.F., Drasgow, F., Hulin, C.L., Gelfand, M.J., & Magley, V.J. 1997).
This legislation provides protection against employment discrimination of any kind. As long as a person is able and willing to work, he/she cannot be discriminated against provided their skills match the job for which they have applied. Discrimination exists in various forms and each form is discussed below for clearer understanding of the issue.
