Abstract

Over the past decade, the concept of cyberspace has grown from science fiction into a socially structured reality. As a political economy of information capital expands, the intellectual ‘land grab’, that is at present taking place for control over cyberspace, is producing new features between acceptable and nonstandard activities, besides creating new public demands for regulation. Many activities are becoming categorized as criminal and now sit next to those behaviors for which a cure is found in criminal law. New types of risk communities now go together with the old. This kind of situation has created some remarkable, but often conflicting situations. On the one hand there are some growing public fears over the powerlessness of recognized authorities to control behavior in cyberspace. Moreover in contrast, there are quite clear examples of scare mongering by the growing cyber-crime industry. Characteristic of the latter is the letdown to disaggregate between the potential and definite harms that happen in, or as the result of, cyberspace, consequently increasing the public fear, either to get a new commercial market or to secure public funds.

This paper investigates some of the multifaceted issues surrounding the lack of knowledge about cyber crimes and how they may "regulated" by criminal law. It will, initially, look in brief at why the cyberspace needs to be regulated, particularly at what people at present understand as a "cybercrime" and comments upon who are the victims and who are the offenders. Then there are strategies that exist for the policing of cyberspace and in fact, who are actually policing it. Then there are some conclusions.

The internet-based communications industry has, during the 1990s, quickly contracted into the planned thinking of Governments, their constituent institutions and also the major international companies. However together with the exceptionally advantageous aspects of fundamental life come the dark side and it is with this in mind that a somewhat contradictory situation is emerging....
