Conflict theory in criminal justice is based on the assumption that society is grounded in inherent conflict that cannot be resolved. Marxist theory focused on the mode of production in way how society organizes itself in order to accomplish production. This also included the class groups, which in some way or the other were involved in the means of production.
The centrality of the class conflict was that each system of production (capitalism, feudalism, etc.) is characterized by conflict between classes and this conflict and inequality is the most basic feature of society. The three basic critiques that Marxist proposed on the criminal justice system was that it reflected the ideas and interests of the dominant class; secondly formal equality as an “ideological fig leaf” that masks class and social inequality and legitimates capitalism and thirdly that criminal justice systems primarily detects and punishes the crimes of the poor.................
