In the common law, most often duty of a person is referred to in terms of association or relationship between two people or parties; or the relationship of Mr. A with Mr. B in terms of relationship that B has with A's property. Moreover, when Mr. A invites Mr. P on his property, the automatically Mr. A is then said to have assumed a unique relationship with Mr. B. there are three main categories that are defined under this relationship.

The first type of class is of Trespassers. It is in, general, held that the owner of the land or property does not have any duty to the trespasser. However, in many cases there are established exceptions to this principle.

Moreover, Trespassing during the 13the Century was considered fundamentally a criminal violation. It was taken as use of force against the owner's property. The fact that there was use of force was taken as proof enough in order for the plaintiff to succeed, and subsequently any further clarification or test were not needed for the person to be declared guilty and the blame of charges to be consigned. This is referred to as action in trespass.
